license. Licensing of contractors, other than electrical and asbestos abatement, is for
revenue purposes only.

Contractors are required to register in order to bid on the Department of Transportation
contracts

Requirements?

Contractors:
Licenses are issued or renewed for a 1 year period, expiring on December 31st, for a fee of $75. An application for license must be filed by the time a competitive bid is submitted on competitively bid contracts exceeding $50,000. Every contractor must pay a gross receipts tax at the rate of .499% (.00499) times the taxable gross receipts received from construction services. The first $80,000 of construction gross receipts received per month ($240,000 quarterly) is exempt from the gross receipts tax. Contractors must, within 10 days of entering into a contract with a non-resident contractor, file with the Division of Revenue a statement of the total value of such contract. Failure to file such a statement may subject the contractor to a $10,000 civil penalty for each occurrence.

Electricians:
Any electrical contractor must be, or employ a master electrician who holds a license issued by the State Board of Electrical Examiners. Examination requirements exist for all electrical licenses. Examinations are given 6 times a year and a grade of at least 75% is required. Experience and education requirements range from 3 to 6 years. Master/Master Special Applicants must furnish proof of liability insurance in the amount of $300,000. Licenses are issued for up to 2 years, expiring on June 30th of even numbered years for all classes of licensure.

As a condition of renewal, each applicant must complete Board Approved continuing education. 10 hours of Board Approved continuing education is required for licenses in effect for over 2 years and 5 of the 10 hours must be code related. For licenses in effect for over 1 year, but less than 2 years, the applicant must complete 5 hours of Board Approved continuing education, while those licensed less than 1 year at renewal are not required to obtain continuing education.

Asbestos:
Contractors must be certified by the Division of Facilities Management and
shall notify the Department of Natural Resources and Environmental Control before
undertaking any asbestos abatement work.

All licenses are issued on an annual basis from the date of the required training The
average processing time for any application is 3 weeks. Project Monitor applications
are evaluated on an individual basis and require the submission of a photo, a resume and training credentials. All DE asbestos related identification cards must now be picked up by the person identified on the license, and the presentation of a valid government issued photo ID (i.e., State Driver's License/State issued Identification card) is required at time of appointment.

Solid Waste:
A permit to transport all solid waste, including infectious waste or asbestos, in or through the State of Delaware must be obtained. Proof of liability insurance and submission of driver training and spill control plans are required. There is an annual reporting requirement with all renewals. The annual permit fee is $350. This fee covers the $300 annual permit fee and a $50 public notice fee.

Underground Storage Tanks:
Companies and supervisors are required to be certified to perform UST installations, retrofits, removals or closure-in-place. Both company representatives and supervisors must show relevant training or experience and pass an examination with a score of 80%. The 2 year certification and subsequent biennial renewal fee is $250 for companies and $100 for supervisors. Companies must have a current Delaware Business License and show proof of a minimum of $1,000,000 general liability insurance and a minimum of $250,000 pollution liability insurance.

Division of Revenue:
All non-resident contractors are reminded that they must supply a surety or cash bond to the Division of Revenue equal to 6% of the total of all contracts exceeding $20,000 for construction within this state. For Division of Revenue purposes, cash bonds and bank letters of credit issued by financial institutions will be accepted on all contracts.

RECIPROCAL AGREEMENTS
Asbestos supervisors/workers trained by EPA-approved trainers may request certification by reciprocity. The State of Delaware has reciprocity only with the Region III states for Class "A" supervisors/workers, not contractors. Consideration under reciprocity is based on EPA-approved training courses, and all courses must have been taught within a Region Ill states boundaries. Region Ill states are Delaware, Maryland, Pennsylvania, Virginia, West Virginia, Washington DC, City of Philadelphia and Allegheny County, Pennsylvania.
